Terms of Service - FindMyNganya

These Terms of Service ("Terms") govern your use of the FindMyNganya mobile app and related services (the "App" or "Service"). By accessing or using FindMyNganya, you agree to these Terms. If you do not agree, do not use the App.

1. About FindMyNganya

FindMyNganya helps commuters in Nairobi and other supported areas to view real-time matatu tracking information, browse fleets and route information, join community features (including chats/FanConnect), and submit ratings and reviews. FindMyNganya may rely on user-generated data, driver/device signals, and third-party services to provide these features.

2. Eligibility

You may use the App only if you can legally agree to these Terms. If you are below the age required by law in your country, a parent or legal guardian must review and agree to these Terms on your behalf.

3. Your Account and Access

You may need to create an account to access some features. You agree to provide accurate information, keep login credentials secure, be responsible for activity under your account, and notify us promptly of unauthorized access. We may suspend or restrict accounts used in violation of these Terms.

4. Location, Tracking, and Accuracy

FindMyNganya provides route and vehicle information for convenience. Tracking data may be delayed, incomplete, or inaccurate at times. ETAs and live locations are estimates, not guarantees. Service availability can vary by route, driver activity, device connectivity, and network coverage. Always use your own judgment when planning travel.

5. Community Features, Ratings, and User Content

You are responsible for content you post (messages, reviews, images, ratings, and other submissions). By posting, you confirm you have rights to that content and grant us a non-exclusive, worldwide, royalty-free license to host, display, and use it to operate and improve the Service.

You must not post content that is illegal, abusive, threatening, hateful, defamatory, fraudulent, sexually explicit, exploitative, spam, scam-related, malware-related, or infringing on others' intellectual property or privacy. We may moderate, remove content, or restrict accounts at our discretion to protect users and platform integrity.

6. Acceptable Use

You agree not to misuse the App, APIs, or infrastructure, attempt unauthorized access, scraping, reverse engineering, or interference, manipulate ratings/reviews, impersonate others, or use the Service for unlawful activity.

7. Third-Party Services

FindMyNganya may integrate with or depend on third-party tools/services (for example maps, hosting, analytics, notifications, payment, authentication, media, or social links). Those services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

8. Payments and Transactions (If Enabled)

If paid features, subscriptions, or in-app purchases are introduced, additional pricing and payment terms will apply and be shown before purchase. Unless required by law, fees are non-refundable once charged.

9. Intellectual Property

FindMyNganya, including branding, software, interface design, text, and other original content, is owned by us or our licensors and protected by law. You may not copy, modify, distribute, or commercially exploit our intellectual property except as allowed by law or with our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted availability, error-free operation, or perfect data accuracy. FindMyNganya provides transport information only and is not professional, legal, medical, or safety advice. FindMyNganya is not an emergency service and does not replace police, NTSA, ambulance, hospital, or other official emergency channels.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. We are not liable for losses caused by delays, data inaccuracies, user content, third-party services, or service interruptions. Our total liability will not exceed the amount you paid us (if any) in the 12 months before the claim.

We implement reasonable administrative, technical, and organizational safeguards to protect user data. However, no system is completely secure, and we cannot guarantee absolute security. To the maximum extent permitted by law, FindMyNganya is not liable for unauthorized access, disclosure, alteration, or loss of data caused by events beyond our reasonable control, including cyberattacks, except where such loss results from our gross negligence, willful misconduct, or liability that cannot be excluded under applicable law.

12. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

13. Suspension and Termination

You may stop using the App at any time. We may suspend or terminate access immediately if we reasonably believe you violated these Terms, created risk for other users, or misused the Service.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify users in-app, by website notice, or by other reasonable means. Continued use after updates means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict of law rules, unless mandatory local consumer law requires otherwise.

17. Safety, Incident Reporting, and Lost Property

FindMyNganya is an information and community platform. It is not an emergency response, law enforcement, medical, or rescue service.

If an accident, crime, threat, or medical emergency occurs, users must immediately contact the appropriate authorities and emergency services, including (as applicable) police, NTSA, ambulance, hospitals, or other official responders.
